摘要： 为探索符合我国国情的数据跨境流动机制，选取在发展机制上具有先行先试优势的自贸区为样本，通过文献分析、案例分析，归纳总结了数据跨境流动当前面临的国内外形势，挖掘出数据跨境在高效便利安全上不足的相关问题，提炼出自贸区在数据跨境领域的主要实践经验和特点，从技术、服务、制度三方面提出建议，以期为打造中国特色的数据跨境流动机制提供借鉴。

Research on the situation, current status, and mechanism of cross-border data flow in China——taking the free trade zone as an example

Abstract： To explore a cross-border data flow mechanism that aligns with China′s national conditions, we selected Free Trade Zones (FTZs) with pioneering advantages in development mechanisms as our sample. Through a meticulous blend of literature review and case study analysis, we synthesized the current domestic and international landscape of cross-border data flow. We revealed challenges pertaining to insufficient efficiency, convenience, and security in cross-border data operations, and extracted pivotal practical experiences and characteristics from the FTZs in the realm of cross-border data flow. Based on these insights, we formulated recommendations across technology, services, and systems, aiming to provide invaluable perspectives for constructing a cross-border data flow mechanism that embodies Chinese characteristics.

引言
数据要素在全球贸易发展中日益重要，数据跨境流动已成为全球经济复苏的必要条件，成为数字经济时代全球化发展的重要特征。自由贸易实验区（以下简称“自贸区”）作为我国对外贸易的先锋，积极利用自身制度和政策创新优势，加速开展数据跨境流动探索，已成为数据跨境流动机制创新的前沿阵地，为数据跨境流动积累新经验。本文以自贸区为例，重点探讨了当前数据跨境流动的堵点、痛点、难点，自贸区在数据跨境流动的实践探索，以及哪些方向可以成为下一步发展关键，以期为我国数据跨境流动机制的构建提供借鉴。
